A scooter is a motor vehicle in the eyes of the law
An electric scooter is legally a powered personal transport device and can qualify as a motor vehicle. As a result, its rider is a driver, not a mere pedestrian, which affects compensation.
Hit by a car: the Badinter law applies
If a motor vehicle hits you, the Badinter law protects you: the at-fault vehicle insurer must compensate your bodily injury. Note that, as the driver of a powered device, your own fault can be discussed, unlike a pedestrian.
Solo fall or unidentified third party
For a fall with no third party (pothole, road defect, loss of control), compensation depends on your own insurance and any personal cover. If the party is unknown or uninsured, the French guarantee fund (FGAO) may step in under conditions.
Insurance is mandatory
Riding an electric scooter without liability insurance is illegal and risky: if you are at fault, you may have to compensate the victims yourself. Check your cover.
